These Terms of Use are effective as of July 11, 2025.

TutorNics (“we”, “us”, or “our”) is an online education platform providing personalized one-on-one tutoring services. These Terms of Use govern your access to and use of the TutorNics website (www.tutornics.com) and associated services (“Platform” or “Website”). By using our services, whether as a guest or registered user, you agree to these Terms and our Privacy Policy.

Access to the platform indicates that you accept these terms. If you do not agree, please discontinue the use of our services.

1. Registration and Eligibility

1.1 You must be at least 18 years of age or have guardian consent to use our services. If you're under 18, your parent or guardian must read and agree to these Terms on your behalf.

1.2 When registering, we collect personal data such as your name, email, contact number, location, and student learning preferences. This may be categorized under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

1.3 You are responsible for maintaining the confidentiality of your login details. Access using your credentials is your responsibility, regardless of who uses them.

1.4 You may withdraw consent for data usage by writing to support@tutornics.com, but doing so may restrict access to our services.

1.5 TutorNics reserves the right to terminate or restrict your access if false information is provided or Terms are violated.

1.6 It is the parent’s/student’s responsibility to ensure secure access to their account and device.

2. Services Offered

2.1 TutorNics connects students with qualified online tutors, matching them based on requirements, availability, and past feedback.

2.2 We currently provide one-on-one online classes. Group classes are only considered upon specific parent requests and internal approval.

3. Website Usage

3.1 TutorNics grants you limited, personal, non-transferable access to use the Platform solely for educational purposes.

3.2 Unauthorized duplication, resale, or distribution of Website content is prohibited.

3.3 Misuse or violation of these terms may lead to suspension of access at our discretion.

4. Terms for Parents and Students

4.1 Registration requires accurate details, and parents/students consent to receive communications via email, WhatsApp, or phone.

4.2 We may record your Website usage and feedback to improve services.

4.3 One demo class is offered per student. Further classes require enrollment on agreed fees.

4.4 Classes last for 55–60 minutes. Extra tasks beyond sessions may be billed separately.

4.5 Curriculum and class frequency are mutually decided with TutorNics. Tutors must follow the agreed curriculum. Parents/students may contact support@tutornics.com for clarification.

4.6 TutorNics may record classes for quality monitoring. These remain company property.

4.7 All communication must take place through authorized TutorNics channels.

4.8 If dissatisfied, you may request a change of tutor. This may lead to a revised hourly rate.

4.9 Any misconduct by a tutor must be reported. TutorNics will assess and act on such reports appropriately.

4.10 TutorNics is not liable for hardware/software issues due to use of the Platform.

4.11 We may send updates, offers, or announcements that we believe are useful to you.

5. Payments and Subscription

5.1 Fees are payable in advance each month. Quarterly, half-yearly, and annual subscriptions are available at discounted rates.

5.2 A 7-day non-payment period may result in service suspension.

5.3 Fee revision may occur annually or when the student is promoted. Continuing classes implies acceptance of new rates.

5.4 Prices are inclusive of applicable taxes like GST or VAT.

5.5 TutorNics may offer custom plans or discounts at its discretion.

6. Refund Policy

6.1 No refunds for Monthly Plans.

6.2 For longer plans (Quarterly, Half-Yearly, Annual), TutorNics refunds 80% of unused class fees on a pro-rata basis after deducting a 20% cancellation fee. Claims must be made before plan expiry.

6.3 Refunds are only made to Indian bank accounts and processed within 30 working days. Parents must share account details as requested.

6.4 Missed classes without valid reason are non-refundable. Credits are non-transferable between batches.

7. Limitation of Liability

TutorNics is not liable for any indirect, incidental, or consequential damages arising from the use of the platform, including loss of data or unauthorized access.

8. Disclaimers

8.1 We are not liable for consequences of unauthorized data access or technical issues caused by the application.

8.2 TutorNics does not guarantee uninterrupted access and is not responsible for external disruptions.

9. Indemnity

You agree to indemnify TutorNics, its directors, and agents against any claims arising from your use of the platform, violation of Terms, or unauthorized access to your account.

10. Warranties

By using the Website, you confirm that:

• You are 18+ or have appropriate guardian consent.

• Information provided is truthful and current.

• You’ll use the platform only for educational purposes.

• You’ll not misuse or reverse-engineer the platform or introduce malware.

11. Intellectual Property

All content, visuals, branding, code, and material on the TutorNics platform are the intellectual property of TutorNics. You may not reproduce, distribute, or copy them without written permission.

12. Arbitration

Disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996. Arbitration will be held in [Your Business City], India in English. TutorNics may seek court injunctions when necessary.

13. Severability

If any provision is held invalid, the rest of the agreement remains effective and enforceable.

14. Waiver

No waiver by TutorNics shall be effective unless in writing. Failure to enforce a clause does not constitute a waiver of future enforcement.

15. Miscellaneous

If any provision is deemed unenforceable, it does not affect the remainder. Platform operations may be affected by factors outside our control. Notices should be directed to the registered office of TutorNics.
